These specific terms supplement the General Terms of the ALaCarte.Direct Service. In the event of a contradiction, these terms prevail.
Article 1 — Service Description
The Click & Collect service allows the Customer to receive online orders from their End Customers for collection from the establishment or delivery, with online payment.
Article 2 — ALCD's Role
ALCD provides the technical infrastructure for online ordering and payment. ALCD acts as a collection agent within the meaning of Article 6 of the General Terms. The sales contract is established directly between the Customer and the End Customer.
Article 3 — Payout and Commission
Amounts collected on online orders are paid out to the Customer according to the terms and frequency defined in their Stripe Connect account, after deduction of:
- the ALCD commission: 6 % on the standard plan, 2 % for Premium subscribers
- Stripe transaction fees
These rates are those in force on the publication date of this document; any change is notified in advance in accordance with Article 11 of the General Terms.
Article 4 — Customer's Obligations Regarding Distance Selling
The Customer is solely responsible for complying with the regulations applicable to distance selling, in particular:
- pre-contractual consumer information (Article L.221-5 of the French Consumer Code): essential characteristics, price, collection time, identity of the professional
- order confirmation
- exclusion of the right of withdrawal for perishable goods and products prepared to order (Article L.221-28 of the French Consumer Code)
- hygiene and food safety rules applicable to takeaway sales
ALCD provides the templates for pre-contractual information and order confirmation through the Service. The Customer remains responsible for their accuracy and completeness.
Article 5 — Cancellations and Refunds
The Customer defines their cancellation policy in the Service settings. In the event of cancellation or refund, funds are returned to the End Customer via Stripe. The Customer bears any Stripe refund fees.
Article 6 — Quality and Compliance of Products
The Customer is solely responsible for the quality, compliance and food safety of the products they sell through the Service. ALCD cannot be held liable for the quality of products delivered or collected.
